Abstract

This research is motivated by a land dispute in the Darmo Hill area Surabaya, which resulted in the Surabaya Land Office I suspending land services, including applications for the extension of Building Use Rights (HGB) submitted by the community. The suspension was based on PT Pertamina (Persero)'s claim to 220.4 hectares of land based on the former Eigendom Verponding Number 1278. This research aims to analyze the validity of the action of refusing the HGB extension by the Surabaya Land Office I and the legal protection for HGB holders who are harmed. This research is a normative legal research with a statutory approach and a conceptual approach supported by a literature study of primary and secondary legal materials. The results of the study indicate that the action of the Surabaya Land Office I in suspending the HGB extension service does not meet the procedural and substantial legal aspects because it is not based on a legitimate blocking mechanism and is only based on a unilateral claim that has not yet had permanent legal force. This action is contrary to the General Principles of Good Governance (AUPB). Legal protection for HGB holders can be achieved through preventive and repressive measures in accordance with statutory provisions.
