Abstract
ABSTRACT The method used in this study was a normative juridical method. Data in this study were obtained from official documents, books related to research objects, research results in the form of reports, theses, and laws and regulations. This study used primary data obtained from laws and regulations, jurisprudence, or court verdict, meanwhile secondary data were obtained from library sources. The aim of this study is to find out legal protection for hajj pilgrims plus who failed to leave due to the cancellation by travel X Surabaya according to Act Number 8 of 1999 concerning Consumer Protection. The results obtained in this study can be concluded that Travel X in Surabaya has violated several rights of hajj pilgrims plus as consumers, which has been regulated in Article 4 of Act Number 8 of 1999 concerning Consumer Protection. The rights of hajj pilgrims plus that have been violated by travel x in Surabaya were Article 4 section (2), section (3), and section (7). Travel x Surabaya also has violated Article 8 section (1) letter f concerning Prohibited Actions for Business Actors. Legal protection for hajj pilgrims plus that are failed to leave due to cancellation by travel X in Surabaya can be carried out by 2 (two) methods, preventive and repressive legal protections. Preventive protection is from the consumers themselves, in which consumers must be vigilant, active, critical, and by the formation of laws and regulations. Moreover, according to Law Number 8 of 1999 concerning Consumer Protection, repressive legal protection is through non-litigation through Consumer Dispute Resolution Agency (BPSK) or Non-Governmental Consumer Protection Agency (LPKSM), as well as through litigation, which is through the Court in the general court.
