Abstract

Renting farmland in Karanggeneng Village, Karanggeneng District, Lamongan Regency is still mostly done verbally and often causes problems. The legal issues that arise from the lack of a written agreement include problems with changes to the rented farmland made by tenants without the landowner's knowledge. Without a written agreement, problem-solving can be handled through non-litigation methods. Mediation is an effective alternative for dispute resolution. This study uses an empirical legal research method and a legal sociology approach to analyze the application of law in a social context. Data was obtained through observation and interviews regarding farmland rental practices in Karanggeneng Village, Karanggeneng District, Lamongan Regency and analyzed based on applicable civil law regulations. Oral leases of farmland are considered valid because they comply with the provisions in Article 1320 of the Civil Code, which require an agreement between the parties, the capability to make a contract, a clear object, and a lawful cause/clause. According to Hugo Grotius' Principle of Freedom of Contract, oral agreements still have binding power as long as they arise from free consent, are made in good faith, and do not conflict with applicable legal provisions.
