Abstract
This study aims to analyze the implementation mechanism of conditional supervision sentencing for Children in Conflict with the Law (CCL) at the Class I Surabaya Correctional Center and to examine the obstacles and efforts in its implementation. This study employs an empirical juridical research method. The results show that the implementation mechanism of conditional supervision sentencing is carried out through coordination between law enforcement agencies and the Correctional Center, in which Community Counselors play a central role in providing guidance and supervision to Children in Conflict with the Law by involving their families as the primary support system throughout the rehabilitation process. The implementation of conditional supervision sentencing emphasizes the principles of child protection and restorative justice through a rehabilitative rather than a punitive approach. This study identifies a normative obstacle in the form of the absence of specific regulations governing the implementation mechanism of conditional supervision sentencing, resulting in its implementation relying on the internal procedures of the Correctional Center. Other obstacles include the unavailability of Community Counselors during scheduled mandatory reporting sessions due to other official duties and delays in submitting the final recommendation approved by the panel of judges to the data management division of the Class I Surabaya Correctional Center. Additional challenges include children's non-compliance with mandatory reporting requirements and the acceptance of Children in Conflict with the Law by their families and the community upon their reintegration. The Class I Surabaya Correctional Center continues to undertake various efforts to overcome these obstacles and improve the implementation of conditional supervision sentencing.
