Abstract

This study examines the legal status and evidentiary value of Eigendom Verponding land rights following the enactment of Law No. 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA). The research stems from the continued existence of land parcels formerly subject to Western land rights that have not yet been converted to the national land rights system, leading to potential ownership disputes and legal uncertainty. Consequently, the study aims to analyze the legal status and evidentiary value of Eigendom Verponding documents regarding land ownership in the post UUPA era. A normative legal research method is employed, utilizing statutory, conceptual, and jurisprudential approaches. Legal materials comprising primary, secondary, and tertiary sources are analyzed using a descriptive qualitative method. The results indicate that, since the introduction of the UUPA, Eigendom Verponding documents no longer constitute absolute proof of land ownership unless the right has been converted into full ownership right in accordance with applicable legal provisions. Courts regard such historical documents as insufficient unless supported by valid evidence of conversion and land registration. Unconverted land with Eigendom Verponding status therefore creates legal uncertainty regarding rights to the land in question. Land registration thus serves as a crucial instrument for establishing land status and minimizing.
