Abstract
This study analyzes the legal relationship between digital platform companies and online motorcycle taxi driver partners, comparing the concepts of employment and partnership relationships, examining the forms of legal protection for partners experiencing unilateral termination of partnership relationships, and analyzing the legal remedies available to partners. The research method used is normative legal research with a statute approach, a conceptual approach, and a case approach. The legal materials used consist of primary, secondary, and tertiary legal materials analyzed qualitatively. The results indicate that the relationship between digital platform companies and driver partners is essentially constructed as a partnership relationship based on the principle of freedom of contract as stipulated in Article 1338 of the Civil Code. However, in practice, this relationship exhibits elements of work, orders, and wages that approximate the characteristics of an employment relationship. Legal protection for partners remains weak because partnership agreements take the form of standard contracts that give digital platform companies dominant authority to impose sanctions and deactivate accounts unilaterally. Legal protection can be provided through preventive and repressive measures, while legal remedies that partners can pursue include non-litigation dispute resolution and litigation through lawsuits for breach of contract and unlawful acts.
