Abstract

The practice of buying and selling thrift balls through TikTok Shop raises legal issues in the form of mismatches between goods received by consumers and those promised by business actors. This study analyzes the violated consumer rights, available legal protection, and the liability of business actors for the delivery of non-conforming goods based on Law Number 8 of 1999 concerning Consumer Protection. This study uses a normative juridical method that is descriptive prescriptive. The results of the study indicate that the actions of business actors who intentionally send non-conforming goods constitute a violation of Articles 4 and 7 of the Consumer Protection Law. These actions can be analyzed based on the principles of presumption of liability and negligence, so that business actors are obliged to bear consumer losses and consumers have the right to demand accountability through non-litigation channels through the BPSK or litigation channels in the form of civil lawsuits to the courts.
