Abstract
This study analyzes the settlement of breach of contract (wanprestasi) in boarding house room rental agreements in Sananwetan District, Blitar City, by examining differences in legal implementation between detailed written agreements and oral agreements accompanied by simple written statements. The findings show that dispute resolution mechanisms are carried out through a gradual non-litigation approach, starting from verbal warnings, deliberation, to enforcement actions in the form of temporary retention of the tenant’s belongings in cases of non-cooperation. The main obstacles faced by boarding house owners include tenants who evade their obligations, the limited sanction clauses in oral agreements, and the dilemma between enforcing rules and the risk of committing an unlawful act. Enforcement efforts are conducted by balancing the application of sanctions. This study emphasizes that the validity and strength of the agreement significantly influence the effectiveness of boarding house owners in taking firm action. Therefore, education regarding proper rental agreement standards is crucial for business actors in the area.
