Abstract

This study is motivated by the debate regarding the use of the concept of potential loss in proving the element of financial loss to the state in corruption cases following Constitutional Court Decision No. 25/PUU-XIV/2016, which requires the existence of actual loss. The urgency of this study lies in the inconsistency in the application of legal norms in Decision No. 34/Pid.Sus TPK/2025/PN Jkt.Pst, which continues to use “potential loss” as the basis for proving state loss. The research results indicate that the state loss amounting to Rp515,408,740,970.36 was calculated using estimative and comparative methods that constitute potential loss, thus failing to meet the actual loss standard as mandated by the Constitutional Court Decision. Furthermore, the judges’ reasoning is deemed misalignment with Constitutional Court decision because they continued to accept the BPKP report as the basis for proving state loss.
