Abstract

Land ownership certificates play an important role in providing legal certainty and protection for land rights holders. Technological developments have encouraged the government to implement land digitalization through an electronic land registration system in order to improve efficiency, transparency, and data security. However, the process of converting analog certificates into electronic certificates, particularly during the land remeasurement stage, has the potential to create discrepancies in land area. This condition may affect the clarity and validity of land sale and purchase agreements, especially when transactions are conducted before the official remeasurement results are determined. This study aims to analyze the effect of discrepancies in land area resulting from remeasurement on the validity of sale and purchase objects, as well as the legal remedies available to disadvantaged parties. The research employs a normative legal method using statutory and conceptual approaches through the examination of land regulations, the Indonesian Civil Code, and the Consumer Protection Law. The results of the study indicate that discrepancies in land area may affect the validity of the sale and purchase object when there is a mismatch between the agreed land area and the actual physical condition of the land. Furthermore, disadvantaged parties are entitled to legal protection and compensation in accordance with the applicable laws and regulations.
