Abstract
The reintroduction of the offense of insulting state institutions in the reform of the National Criminal Code through Law No. 1 of 2023 raises concerns about restrictions on freedom of expression. This study aims to analyze the provisions of this offense in Indonesia and formulate ius constituendum through comparisons with Germany. The method used is normative legal research with legislative, conceptual, historical, and comparative approaches analyzed qualitatively. The results show that the provisions of Articles 240–241 of the National Criminal Code still have weaknesses in the form of unclear boundaries between criticism and insults, which have the potential to give rise to multiple interpretations and implications for legal uncertainty because they can criminalize public expression. In contrast, Germany in this case applies more restrictive provisions while still protecting criticism as a constitutional right. Therefore, it can be concluded that it is necessary to emphasize the limits, guarantee the protection of constitutional rights, and a restrictive approach to achieve a balance between the protection of state institutions and freedom of expression.
