Abstract

This study examines the disparity in the use of evidentiary tools in split cases of narcotics crimes, focusing on Decision Number 27/Pid.Sus/2025/Pn Mgt and its relation to other decisions arising from the same incident. The issues analyzed the judge’s ratio decidendi in setting aside evidence in split cases and its implications for the application of the principle of equality before the law. The findings indicate that the judicial considerations in Decision Number 27/Pid.Sus/2025/Pn Mgt place greater emphasis on proving the act of narcotics abuse committed by the defendant, resulting in certain items of evidence related decisions, which potentially leads to legal disparity. This condition affects the consistency of the evidentiary system and raises issue in realizing the principle of equality before the law, as defendants involved in related incidents are assessed under different standards of proof, thereby reducing legal certainty and the sense of justice.
