Abstract
This study aims to analyze and examine in depth two crucial issues: (1) the form of consumer protection against the circulation of ice cream containing very high alcohol content (40%) and (2) the legal remedy mechanisms that can be taken by consumers who are harmed by the product. This study uses a normative legal research method with a focus on the study of legislation (statute approach) and legal concepts (conceptual approach). The main primary legal materials include Law Number 8 of 1999 concerning Consumer Protection (UUPK) and Law Number 18 of 2012 concerning Food. The results of the analysis indicate that the circulation of products with a 40% alcohol content without clear information, warning labels, and age restrictions is a clear violation of Article 4 and Article 8 of the UUPK, particularly regarding the right to safety and the right to information. This indicates that preventive legal protection through regulatory supervision has not been running optimally. For consumers, repressive legal protection in the form of the right to claim compensation (Article 19 of the Consumer Protection Act) can be sought through non-litigation channels at the Consumer Dispute Resolution Agency (BPSK) or through litigation by filing a lawsuit for Unlawful Acts (PMH) at the District Court. Therefore, it is recommended that food regulations be revised strictly to regulate alcohol limits in processed foods and the obligations of business actors.
