Abstract
This research discusses the legal obligation of shopping mall builidng owner to ensure visitor safety and the liability arising from facility malfunction that causes accidents and harms building visitors. Public interest in visiting shopping malls is high, with an average of 20 million visits per day across Indonesia and at least 400 malls operating in the country. Given the high volume of interest and the number of buildings, greater attention needs to be paid to building safety. This study will analyze the legal basis governing the obligations of building users based on Indonesian statutory regulations, and the user's liability under Indonesian civil law. It will also analyze the legal remedies that can be pursued by visitors who suffer accidents due to a malfunction. The basis for demanding compensation is Article 1365 of the Indonesian Civil Code (KUHPerdata), which pertains to unlawful acts that cause harm to others. This research employs a normative juridical research method with a statutory and conceptual approach. Through this method, the research not only describes the applicable norms but also examines the application of the concept of civil liability in the context of legal protection for shopping mall visitors. The finding of this research is that shopping mall users have a legal obligation to meet building reliability requirements and can be held accountable for failure to execute that obligation.
