Abstract

A stowaway is an individual or group of people who board a train without a valid ticket. Several cases of stowaways have occurred, including one in 2023, where two people intentionally boarded the wrong train, Argo Parahyangan 35, without a valid ticket, and one in December 2024, where a Railfan boarded a Jakarta-Yogyakarta round-trip train by taking a screenshot of an online ticket purchase without making payment. This study aims to analyze the violations of stowaways and the compensation they can claim against PT. KAI. The method used is a normative juridical approach with a statutory, case-based, and conceptual approach, supported by literature studies and interviews. The results of the study indicate that stowaways constitute an unlawful act under Article 1365 of the Civil Code. This act also violates Article 132 of Law No. 23 of 2007 and Government Regulation No. 72 of 2009, as well as the principles of propriety and good faith. Compensation that can be imposed includes compensation according to the fare, administrative sanctions in the form of fines, demotion at the nearest station, and blacklisting. PT. KAI has endeavored to implement non-litigation resolution through mediation to provide legal certainty regarding stowaway incidents and prevent similar incidents from recurring.
