Abstract

Shopee offers a Cash on Delivery (COD) payment method that makes it easier for consumers to pay cash upon receipt of goods. However, this system raises issues such as unilateral cancellations by dissatisfied buyers, which can harm sellers financially and reputationally, and can lead to legal issues due to breach of contract. To address this, the rights and obligations of businesses and consumers are regulated in Law Number 8 of 1999 concerning Consumer Protection and the Civil Code. Consumers are required to pay according to the agreement and businesses are required to replace non-conforming goods. Therefore, an in-depth analysis is needed to create fairness in online buying and selling transactions. This research was conducted using a normative juridical legal approach. The method used is a normative case study focusing on legal behavior products, such as an examination of the law. The results show that the agreement between the seller and Shopee meets the legal requirements according to the Civil Code and Government Regulation No. 71 of 2019 concerning the Implementation of Electronic Systems and Transactions. However, the practice of cash on delivery (COD) often results in defaults on the part of both buyers and shipping companies. Shopee, as a platform and shipping provider, has a legal responsibility to protect both parties. Strict regulations and legal literacy are needed to ensure legal certainty in online transactions.
