Abstract
The cosmetics industry in Indonesia has experienced rapid growth; however, issues concerning the circulation of mislabeled cosmetic products have become increasingly prevalent. Mislabeling occurs when the information stated on a product’s packaging does not correspond to reality, whether in the form of misleading claims, omission of essential information, or inaccuracies in the listed ingredients. This study aims to analyze the unlawful acts committed by business actors and the resulting legal implications from the perspective of Indonesian civil law. The research employs a normative legal method with a statutory and conceptual approach. The findings indicate that unlawful acts related to mislabeling may be held legally accountable under Article 1365 of the Indonesian Civil Code, which stipulates the obligation to compensate for losses arising from unlawful conduct. Business actors proven to have engaged in mislabeling are legally liable for the resulting damages based on the principle of liability based on fault. Consequently, they must compensate consumers for both material and immaterial losses. This study recommends that business actors exercise greater caution in providing product information in compliance with applicable legal provisions and enhance monitoring of marketed products to prevent the circulation of goods that harm consumers. It is expected that this research will contribute to the development of civil law and serve as a reference for readers in understanding legal issues related to mislabeling within the cosmetics industry.
