Abstract

The development of digital technology has led to the emergence of various forms of electronic transactions, including the practice of buying and selling digital music service accounts, such as Spotify, through unauthorized third parties. Although increasingly prevalent, this practice lacks a clear legal basis and potentially violates laws and regulations. This study aims to analyze the legal validity and liability for losses arising from illegal Spotify account buying and selling transactions. The method used is normative juridical, by examining applicable legal provisions and the Spotify Terms and Conditions. The results indicate that these transactions do not meet the requirements for a valid agreement as stipulated in Article 1320 of the Civil Code and are potentially unlawful. This practice also violates several laws and regulations in Indonesia and can be detrimental to both consumers and Spotify. Therefore, strengthening regulations related to digital transactions, stricter law enforcement, and increasing public awareness of the legal risks of illegal transactions are needed.
