Abstract

This study aims to examine the legal protection of songwriters who do not receive royalty payments from cafe owners in Surabaya City. Songs used in live performances in cafes are copyrighted works. Based on Law Number 28 of 2014 and Government Regulation Number 56 of 2021, cafe owners are obliged to pay royalties for commercial use of songs. This study uses a normative juridical method with a statutory and conceptual approach. The results of the study indicate that songwriters have preventive and repressive legal protection that can be achieved through copyright registration mechanisms, membership in the Collective Management Institution (LMK), as well as civil lawsuits and criminal reports for violations.
