Abstract
This study aims to provide knowledge and to analyze the legal status and legal protection provided to gig workers in the creative industry in the digital economy era. The development of technology and digital platforms has given birth to a flexible work model that creates uncertainty about the legal status of workers. Gig workers in the creative industry still face various challenges, including minimal social protection and vulnerability to detrimental practices by digital platforms. The method used in this study is normative legal research with a statutory regulatory approach and a conceptual approach. The results of this study are that the legal status of gig workers in the creative industry based on the Manpower Law in Indonesia is as workers in a Fixed-Term Employment Agreement, because they have fulfilled the elements of an employment relationship in accordance with Article 1 number 15 of the Manpower Law, namely the element of work, the element of wages and the element of orders. Preventive legal protection can be realized through regulations such as Law Number 13 of 2003 concerning Manpower, Law Number 40 of 2004 concerning the National Social Security System, Law Number 24 of 2011 concerning the Social Security Administering Body, Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation to Become Law, Government Regulation Number 35 of 2021 concerning Wages, Government Regulation Number 36 of 2021 concerning Fixed-Term Employment Agreements, Outsourcing, Working Hours and Rest Hours, and Layoffs. Meanwhile, repressive protection is realized through access to the mechanism for resolving industrial relations disputes in Law Number 2 of 2004 concerning the Settlement of Industrial Relations Disputes.
