Abstract

Consumers are individuals who use goods or services available in society, but not for commercial purposes. This research addresses the issue of the discovery of sodium dehydroacetate content in food products, which did not conform to the composition stated during product registration. Sodium dehydroacetate is not among the food additives permitted under Indonesian Food and Drug Authority Regulation (BPOM) Number 11 of 2019 concerning Food Additives. The objective of this study is to analyze the legal protection and liability provided to consumers in relation to the presence of hazardous chemical substances in food products. This study employs normative legal research with a prescriptive approach to provide recommendations for resolving the problems addressed. It applies both statutory and conceptual approaches. The findings reveal that legal protection is categorized into two types: preventive and repressive. Preventive protection is carried out by BPOM as the government authority responsible for supervision, while repressive protection grants consumers the right to seek remedies through litigation and non-litigation channels in the event of harm. In this context, producers’ liability for hazardous chemicals in food is governed by the principle of strict liability under the doctrine of product liability, as stipulated in the Consumer Protection Law. This research is expected to contribute to the development of knowledge related to the issues discussed and serve as a valuable reference for readers in understanding the legal implications of hazardous substances in food.
