Abstract
The writing of this thesis is carried out to examine and analyze the legal protection to gig workers logistics warehouse who experienced default actions, namely the policy of unilateral wage reduction by digital platform providers. The author uses normative legal research methods with literature studies in the form of laws and regulations, principles, doctrines and legal concepts. This normative research refers to regulations, especially Undang-Undang Nomor 13 Tahun 2003, Undang-Undang Nomor 6 Tahun 2023, Peraturan Pemerintah Nomor 35 Tahun 2021, and others. In practice, it is difficult to prove legal actions related to default because the working relationship of the parties is carried out in a partnership relationship and an oral work agreement. Civil law remedies can be made by proving that the oral work agreement is legally valid and that the digital platform provider is responsible by providing compensation to gig workers. Another obstacle is the lack of regulations. It is necessary to establish regulations that would provide legal certainty and ensure employment contracts are fulfilled, along with access to basic gig worker rights. Digital platform providers should implement policies that require them to establish written work agreements with gig workers. Alternative dispute resolution, facilitated by digital platform providers, can be carried out through deliberation and mediation as an effective form of dispute resolution.
