Abstract
ABSTRACT This thesis research was conducted to examine and analyze the implementation of restorative justice principles in the enforcement of juvenile criminal law against criminal acts and terror of sharp weapons by children members of gangster groups in the Surabaya Police, along with the obstacles faced and efforts made to overcome these obstacles. The author uses an empirical legal research method by conducting direct research at the Surabaya Police Satreskrim, Surabaya Class I Correctional Center, and Sawahan Police Criminal Investigation Center to conduct interviews and observations. In practice, the implementation of diversion is not always successfully attempted or carried out, including for the children of members of gangster groups. This is because most gangster children commit criminal acts that are more than 7 years old, such as possession of sharp weapons or even robbery that causes death. The police have tried to optimize the process of investigation, investigation, and case titles to determine the role and involvement of children in the criminal acts committed, so that it can be known whether the child is worthy of diversion or not. Police officers also coordinate with other law enforcement agencies such as the Prosecutor's Office, Correctional Center, and District Court. In addition to coordination between law enforcement agencies, synergy from the community and parents is also needed to achieve a successful diversion process. After conducting research, the author can find out that the Surabaya Police are appropriate in carrying out law enforcement, including the implementation of diversion, when referring to the regulations. The obstacles faced by the Surabaya Police can come from difficulties when conducting investigations and investigations, elements of laws and regulations, sociological society, or the psychological condition of the victim if any.
