Abstract

Violence against children is a very serious crime and requires a firm legal response. Children as legal subjects are very vulnerable to violations of their rights. This study aims to analyze the judge's considerations in two decisions regarding child molestation, namely Decision Number 242/Pid.Sus/2015/PN Tte and Decision Number 6/Pid.Sus/2015/PN Bli, and to determine the judge's views on the acquittal in the child crime case. This study uses a normative legal method, which aims to discuss legal issues related to Law Number 35 of 2014 concerning Child Protection. The elements of the crime of sexual violence against children are regulated in Article 76 letter D and Article 81 Paragraph (2) of the Law. Based on existing legal considerations, a proper understanding of the crime of sexual violence against children is very important, so that efforts are needed to increase socialization to the community regarding the elements of the crime, so that the community better understands the rights and regulations that apply to protect children from sexual violence.
