Abstract

The inclusion of limitation of liability stated by the service provider in the terms and conditions is very worrying because the service user seems to be releasing his/her responsibility for the content generated from the use of his/her service. The inclusion of this clause is then questioned, whether the service provider has good intentions when including it. Aiming to see how the validity of electronic contracts that include limitation of liability and its legal consequences, this study uses a juridical-normative research method with a statutory and conceptual approach to analyze from the perspective of laws and regulations and developing doctrines. The results of this study are that limitation of liability affects the determination of whether or not the requirements of a lawful cause are met, so it is necessary to see whether its inclusion is accompanied by good intentions and does not conflict with legislation, public order, and morality. If it does not meet these requirements, then the electronic contract is declared null and void. The legal consequences are that the contract applies like a law for the parties if the service user agrees to the terms and conditions. The limitation of liability listed by the GenAI service provider is usually a limitation stating that it is not responsible for the content generated from the use of its services. So, when the user agrees to the terms and conditions of the service, he must also understand that the responsibility for the content generated is his responsibility.
