Abstract
The massive scale of e-commerce trading activities increases the risk of package loss during shipping, even when the goods are covered by insurance. This research aims to examine the legal protection framework for consumers who lose insured electronic purchases under Indonesian positive law. Furthermore, it analyzes the legal liability of sellers, courier services, and insurance companies regarding the losses suffered by consumers. The study employs a doctrinal method (normative legal research), combining statutory and conceptual approaches. A qualitative analysis was conducted on literature data comprising primary, secondary, and tertiary legal sources. The findings confirm that legal protection for consumers is facilitated through preventive and repressive instruments derived from Law No. 8 of 1999 on Consumer Protection, the Commercial Code, the Law on Electronic Information and Transactions, and the Insurance Law. Liability for lost shipments is distributed proportionally among business operators, courier service providers, and insurers, based on contractual obligations and the respective legal duties of each party. The study concludes that legal protection for e-commerce consumers remains suboptimal due to complex insurance claim procedures and ambiguities regarding the allocation of liability. Therefore, strengthening regulations to ensure legal certainty and improving the efficiency of conflict resolution systems are urgently needed.
