Abstract

This study examines the legal analysis of nominee agreement practices involving elements of fraud from a civil law perspective. In this context, a nominee agreement refers to an arrangement where an Indonesian national lends their name to a foreign national regarding land ownership rights. Such agreements, involving a foreign national as the party with the actual economic interest and an Indonesian national as the formal titleholder, have become increasingly prevalent in Indonesia's tourist destinations. This research aims to analyze the legal status of nominee agreements within the Indonesian civil law framework, specifically regarding the legal avenues available to foreign nationals and the nominee's legal liability in cases of unilateral control. The study employs a normative-juridical method, utilizing both statutory and case-based approaches. The findings indicate that the Indonesian legal system currently fails to provide adequate legal certainty or protection for resolving disputes arising from nominee agreements; consequently, comprehensive normative reform is required to address the legal vacuum that has facilitated the circumvention of the law in property investment practices.
