Abstract

This study aims to analyze the legal basis for determining the reserve price in the execution auction of mortgage rights under Regulation of the Minister of Finance Number 122/PMK.06/2023 and to examine the judges’ legal considerations in the District Court of Sidenreng Rappang Decision No. 22/Pdt.G/2023/PN Sdr. The research employs normative legal methods with statutory, conceptual, and case approaches, conducted through literature review and qualitative analysis of court decisions. The findings indicate that the reserve price must be based on an independent appraisal in accordance with Articles 55–57 of PMK 122/2023, while observing the principles of legal certainty, fairness of value, and debtor protection. In the Sidenreng Rappang case, the judges held that reducing the reserve price from IDR 135,075,000 to IDR 60,000,000 without an independent appraisal constituted a legal defect, rendering the auction minutes null and void despite the issuance of a new land certificate. This decision underscores that the protection of bona fide purchasers does not apply when the auction process itself violates the principle of legal certainty. The study concludes that transparency and professionalism in reserve price determination are essential to balance creditor interests and debtor rights, while also establishing a judicial precedent on the limits of creditor authority and the legal consequences of defective auctions.
