Abstract
The rapid growth of e-commerce has led to the emergence of practices involving the sale of Netflix accounts through third parties on platforms such as X, Shopee, and Instagram at prices lower than the official rates. This practice raises legal issues, particularly regarding the validity of agreements and the protection of consumers who suffer losses. This study aims to analyze the validity of agreements in electronic transactions for the purchase of Netflix accounts through third parties, as well as the forms of legal protection for consumers based on Law No. 8 of 1999 on Consumer Protection and Law No. 11 of 2008 on Electronic Information and Transactions, along with their amendments. The research method used is normative legal research with a legislative and conceptual approach. The results of the study indicate that purchase agreements for Netflix accounts through third parties do not meet the requirements for a valid agreement as stipulated in Article 1320 of the Civil Code, particularly regarding the elements of a specific subject matter and a lawful cause, rendering such agreements null and void. Furthermore, consumer protection under these two laws has not been effectively implemented due to the nullity of the agreement, consumer involvement in invalid transactions, and obstacles such as the anonymity of business actors in the digital space, lack of transparency, unclear business actor identities, and weak oversight.
