Abstract

This study examines consumer rights protection in pre-project apartment sales transactions that experience default, with a case study of the Surabaya District Court decision Number 65/Pdt.G.S/2024/PN Sby. Using a normative legal research method, this study analyzes the relationship and legal position of consumers and the application of the Consumer Protection Law (UUPK) in the judge's considerations. The results of the study show that consumers are vulnerable due to standard clauses in agreements that favor developers, such as delays in handing over units even though full payment has been made. This breach of contract violates consumers' basic rights to comfort, clear information, and legal certainty. The judge's decision to grant the consumer's claim and order a refund proves that litigation is an effective means of compensating consumers for losses resulting from contract breaches by developers.
