Abstract
The Fixed-Term Employment Agreement (PKWT) is one of the forms of employment relationships commonly found in the Indonesian labor market; however, problems related to the protection of workers' rights, particularly compensation payments at the end of the contract period, are still frequently encountered during its implementation. This research analyzes the legal protection for PKWT workers who do not receive compensation at the end of their contract, with a case study focus on PT. Z. The issues include the situation of PKWT workers who do not receive compensation after the one-year contract ends, highlighting the power imbalance where the company fails to fulfill its compensation obligations due to a lack of understanding or disregard for regulations. The research adopts a normative legal method that analyzes legal provisions, forms of protection, and reviews the case of non-payment of compensation by PT. Z. Data collection was conducted through literature studies, interviews with the Surabaya Manpower Office and affected workers, as well as tracing official government sources and academic databases. The research results indicate that the obligation to compensate PKWT workers is a legal protection regulated under Law Number 11 of 2020 concerning Job Creation and Government Regulation Number 35 of 2021. Employers who violate this can be subject to administrative sanctions, including written warnings, restrictions on business activities, and even the revocation of business licenses. Legal protection for PKWT workers is available in a preventive form through contract registration and labor supervision, as well as in a repressive form through the resolution of industrial relations disputes via bipartite negotiations, mediation, and lawsuits in the Industrial Relations Court.
