Abstract
The needs of the community make it increasingly strengthen the acceleration of apartment sale and purchase transactions, problems arise when there is default, especially when the seller does not return the booking fee. This research contains problem formulations, including 1) What are the legal consequences for party who make defaults against the booking fee agreement? 2) How is the legal protection for the party who is aggrieved due to default in the booking fee agreement? The research methodology utilized in this research is normative jurisprudence. The findings of the research show that the seller who does not return the booking fee based on the sale and purchase agreement is included in the act of default in accordance with theprovisions of Article 1239, Article 1243, and Article 1267 of the Civil Code, and is contrary to the principle of pacta sunt servanda and the principle of good faith that underlies every contractual relationship, legal protection for the injured party due to default in the booking fee agreement is the implementation of the principles of justice, legal certainty, and good faith according to the CivilCode and the UUPK in every contractual relationship.
