Abstract

The study is entitled “The responsibility of the publisher for copyright infringement for the replay of a cinematographic work on the Tik Tok app." This research has been discontinued due to copyright infringement on cinematographic works. A cinematographic work is a creation of moving images, including documentaries, commercials, reports or story films made with scripts, and cartoons. Along with technological advances, the medium of filmmaking has also progressed. The progress that can be seen is in cinematographic works that are easily accessible only through legal streaming apps that are available on smartphones or other electronic media. In addition to facilitating it, acts against the law can also result from such progress. So, when an act against the law occurs, what about the protection and civil liability of the law as a result of the violation? The research used in this research is normative law or doctrinal law research. Normative law research is one of the types of legal research that, in its process, is based on the logic of legal science from its normative side. In this study, the researchers approached legislation by analyzing the correlation between one legal regulation and another regulation that is relevant to the issue. From this study, it can be concluded that the retransmission of a cinematographic work in the Tik Tok application belongs to the forms of copyright infringement and the types of legal protection provided. It fulfills the elements of unlawful acts of such copyright infringement as well as the form of civil liability for the publisher for the copyright violation that has occurred.
