Abstract

The humanitarian crisis experienced by the Rohingya in Myanmar is one of the biggest challenges to international humanitarian law in the 21st century, where the actions of the Myanmar state government based on the Burma Citizenship Law of 1982 have led to statelessness and gross human rights violations that lead to genocide. This study formulates a problem regarding how to regulate and effectively use the principle of responsibility to protect (R2P) in providing protection for the Rohingya ethnic group. The purpose of this study is to analyze the position of responsibility to protect (R2P) in international law and the obstacles to its implementation in Myanmar. Using normative juridical research methods and qualitative approaches, this study examines secondary data from various legal literature and international documents. The theoretical basis used is the principle of sovereignty as responsibility and the three pillars of responsibility to protect (R2P) adopted at the 2005 World Summit. The results of the study concluded that although the Myanmar state has clearly failed to protect its population according to Pillar 1, international intervention according to Pillar 3 is still hampered by global political interests within the UN Security Council and the principle of regionalism in ASEAN. Therefore, it is necessary to strengthen the legal basis of responsibility to protect (R2P) in order to be more internationally binding and diplomatic pressure for the Myanmar state to revise its citizenship law, namely the Burma Citizenship Law of 1982 to provide equal legal protection for the Rohingya ethnic group as their citizens. Keywords: Responsibility to Protect, Rohingya Ethnicity, Myanmar, State Sovereignty, Genocide.
