Abstract

Child adoption for Muslim petitioners in Indonesia is governed by two concurrent legal frameworks positive law and Islamic law resulting in overlapping adjudicatory authority between the District Court and the Religious Court. Although Article 49 of Law Number 3 of 2006 establishes such petitions as falling within the absolute jurisdiction of the Religious Court, the Nganjuk District Court granted the petition in Ruling Number 32/Pdt.P/2025/PN.Njk, despite being aware of the petitioner's Muslim status. This study employs a normative legal research method with an explanatory nature, utilizing statutory, case, and conceptual approaches to analyze the District Court's legal standing in hearing the petition specifically regarding absolute judicial competence and the legal consequences of the issued ruling. The findings indicate that the Nganjuk District Court lacked absolute jurisdiction to hear the case, as doing so contravened Article 49 letter a point 20 of Law Number 3 of 2006 in conjunction with Supreme Court Circular Letter (SEMA) Number 3 of 2018. The ruling contains a fundamental procedural defect, rendering it potentially void by operation of law; it fails to meet formal adoption requirements and gives rise to inconsistencies with Islamic law, potential inheritance disputes, "forum shopping" practices, and a dualism of legal outcomes. The study concludes that the consistent enforcement of absolute jurisdiction is essential to ensure legal certainty for the adopted child.
