Abstract
Motor vehicle theft remains a common crime within the jurisdiction of the Surabaya City Police. Among the cases handled, some perpetrators re-commit crimes after previously serving their sentences (recidivists). This situation poses a unique challenge in law enforcement against recidivist motor vehicle theft perpetrators. This study uses an empirical juridical method with data collection techniques through interviews, observations, and literature studies. The problem in this study is that there are still many repeat offenders of motor vehicle theft in the Surabaya area. This problem indicates that the law enforcement process against recidivist. motor vehicle theft perpetrators is still not optimal because there are still obstacles and the perpetrators do not have a deterrent effect, so the perpetrators re-commit the crime. The results of the study indicate that law enforcement is carried out through the stages of investigation, inquiry, identification of perpetrators, examination of suspects, collection of evidence, until the case file is declared complete (P-21). Obstacles faced include limited evidence, a lack of witnesses, the perpetrator's evolving modus operandi, and a lack of public participation. Police investigators also implemented various mitigation measures to address the limited evidence, the lack of witnesses, the perpetrator's evolving modus operandi, and the lack of public participation.
