Abstract

Criminal conspiracy in narcotics offenses raises issues concerning criminal liability, particularly for offenders who have different levels of involvement within a narcotics network. This study aims to examine the criminal liability of perpetrators involved in criminal conspiracy and to analyze the judicial considerations in Decision Number 444/Pid.Sus/2024/PN Mlg. This research employs a normative juridical method using statutory, case, and conceptual approaches. The results indicate that the defendant fulfilled the elements of criminal conspiracy as stipulated in Article 132 paragraph (1) of Law Number 35 of 2009 concerning Narcotics. However, based on the facts revealed during the trial, the defendant's involvement was limited to carrying out orders from other parties and was not proven to be the principal actor in the production of narcotics. Therefore, judicial considerations should not merely focus on the fulfillment of the elements of the offense but should also take into account the degree of the defendant's involvement so that the imposed punishment is more proportional and reflects substantive justice.
