Abstract
The crime of theft is one of the most common offenses in the jurisdiction of the Bangkalan District Attorney’s Office, with a total of 229 cases over the past three years, from 2023 to 2025. The high number of cases is directly proportional to the volume of evidence that the prosecutor’s office must manage, making the process of returning evidence to victims an issue that requires in-depth examination. The return of evidence is part of fulfilling the victims’ rights as guaranteed by law; however, in practice, there is a discrepancy between statutory provisions and on-the-ground practices, particularly regarding return times that exceed the established deadlines. The timeframe stipulated in Article 2 of the Attorney General’s Regulation No. PER-002/A/JA/05/2017 sets a limit of 14 working days. However, in practice the average time for the return of evidence far exceeds this stipulated duration. This study aims to analyze the implementation of the return of evidence as an effort to fulfill the rights of victims in criminal theft cases at the Bangkalan District Attorney’s Office, as well as to identify the obstacles and efforts made in the implementation process. The research method used was descriptive empirical legal research employing a statutory approach and a socio-legal approach through direct observation and interviews. The study’s findings show that the average duration of restitution exceeds 30 days; in some cases, it even takes more than a year. These delays are caused by a lack of detail in the written Standard Operating Procedures governing the time limits for restitution after a final and binding judgment, resulting in the victims’ rights not being fully upheld.
