Abstract

This study is motivated by the gap between prenuptial property-separation agreements and the practice of spouses using joint accounts, which creates legal uncertainty regarding asset mixing. Its urgency lies in the absence of clear regulation on the position of joint accounts in proving asset mixing in marriages with prenuptial agreements. Using a normative legal method with case, statutory, and conceptual approaches, this study analyzes Surabaya Religious Court Decision Number 1740/Pdt.G/2025/PA.Sby. The results show legal protection is realized through the binding force of the prenuptial agreement (Article 29 of Law Number 1 of 1974 as amended by Law Number 16 of 2019 and Article 1338 of the Civil Code) and proof of fund origin (Article 1865 of the Civil Code). It is concluded that using a joint account in a marriage with a property-separation agreement constitutes a deviation from the prenuptial agreement, contradicting the good faith principle (Article 1338 paragraph (3) of the Civil Code).
