Abstract

This study examines the urgency of regulating meaningful participation in the procedure for nominating constitutional judges by the House of Representative and the appropriate placement of such regulation within the hierarchy of laws and regulations. The study is motivated by the absence of a clear participatory mechanism, which grants broad discretion to the nominating institution and may result in a selection process that is less transparent and accountable. It aims to analyze the normative weaknesses of the current framework and to formulate an ideal regulatory construction based on the principle of meaningful participation. This normative legal research employs statutory, conceptual, and case approaches. The findings show that the existing regulation remains general and declarative, without procedure guarantees for meaningful public involvement. Therefore, a more comprehensive statutory regulation is needed to ensure a transparent, accountable nomination process consistent with judicial independence.
