Abstract

Children in conflict with the law require special treatment through diversion mechanisms as regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which emphasizes restorative justice. One common crime involving children is assault as regulated under Article 170 of the Indonesian Criminal Code. This study aims to analyze the implementation of diversion for juvenile assault cases at the District Court of Sidoarjo Regency, as well as its obstacles and efforts. This research uses an empirical juridical method with statutory and conceptual approaches. The results show that diversion has been implemented in accordance with Supreme Court Regulation Number 4 of 2014 but remains suboptimal. Out of 30 cases from 2021–2025, only 3 were successfully resolved through diversion. The main obstacles include legal factors, law enforcement officers, facilities, and the low willingness of victims to reach reconciliation. Efforts include strengthening the role of judges, improving coordination among law enforcement, and increasing public awareness. This study recommends optimizing diversion through improving human resources and legal awareness. Keywords: Diversion, Children in Conflict with the Law, Assault, Restorative Justice, District Court
