Abstract
This study is driven by the issue arising from a financing firm's retraction of fiduciary guarantees without following legal protocols, which adversely affects the borrower. The main emphasis is an examination of the Gresik District Court ruling No. 102/Pdt. G/2024/PN. Gsk, which deemed the petition as inadmissible (Niet Ontvankelijke Verklaard) based on procedural grounds, thereby overlooking the essence of the company's accountability. This investigation seeks to dissect the reasoning behind the judge's decision and establish the civil liability of the company through the vicarious liability principle (Article 1367 of the Civil Code), which asserts that an employer is liable for the actions carried out by their employees in the course of their work duties. Employing normative legal research techniques utilizing statutory, case-based, and conceptual frameworks, the data is assessed qualitatively. The innovation of this research lies in scrutinizing the implementation of vicarious liability concerning employees who were no longer employed when the lawsuit was initiated. Additionally, this study proposes an advanced legal framework for judges that transcends procedural constraints to secure substantial justice for borrowers negatively impacted by the arbitrary practices of financial institutions.
