Abstract

This study was prompted by incidents of violence against student journalists while they were covering demonstrations against the 2020 Omnibus Law in Surabaya, which revealed a gap between the guarantee of press freedom and legal protection in practice. This study aims to analyze whether the actions of police officers against student journalists covering the demonstrations constitute criminal acts of violence, as well as to examine the form of legal protection that should be provided to student journalists as victims. This study employs a normative legal method using a legislative and conceptual approach, supported by interviews with the victims. The findings indicate that the actions of law enforcement officers against student journalists covering the 2020 Omnibus Law demonstrations in Surabaya constitute the elements of the criminal offense of assault as defined in Article 351 of the Criminal Code (KUHP). This study also indicates that legal protection for student media should be provided through both preventive and repressive mechanisms. However, in practice, the protection received by the victims has not been optimal, as it is limited to initial assistance and does not extend to the protective mechanisms available under existing legislation.
