Abstract

The crime of violence against children committed under intoxicated conditions raises issues in determining criminal liability, particularly concerning the capacity for responsibility and the principle of fault. This study aims to examine the imposition of criminal sanctions through an analysis of Decision Number 108/Pid.Sus/2025/PNTbn. The focus of the study includes the regulation of criminal responsibility under the old Criminal Code and the new Criminal Code, as well as an analysis of judicial considerations. This research employs a normative juridical method with statutory, case, and conceptual approaches. The results indicate that intoxication does not eliminate criminal liability when it arises from the perpetrator’s own will. The acquittal rendered in the case is considered inappropriate, as the defendant still bears fault by intentionally placing himself in an intoxicated condition that could potentially lead to harmful consequences. Therefore, the defendant should be held criminally liable.
