Abstract

Divorce brings significant legal consequences to the fulfillment of children's rights, particularly the right to support covering maintenance, education, and health costs. This study aims to analyze the provisions of child support obligations after divorce based on Law Number 1 of 1974 concerning Marriage, the Compilation of Islamic Law, and Supreme Court Circular Letter No. 3 of 2015, as well as the determination of the amount of child support in Decision Number 916/Pdt.G/2024/PA.JP reviewed from the principle of the best interests of the child. This study uses a normative legal research method with a statutory approach and a case approach. The results show that the three legal instruments discussed consistently emphasize that the obligation to provide child support is absolute and is not removed by divorce, with Supreme Court Circular Letter No. 3 of 2015 providing a progressive breakthrough in the form of an automatic support increase mechanism of 10% to 20% per year. Decision Number 916/Pdt.G/2024/PA.JP does not fully comply with the principle of the best interests of the child due to an inaccurate interpretation of the phrase "excluding education and healthcare costs" in the Supreme Court Circular Letter. Consequently, these two components are not included in the decision at all. Keywords: Child Support, Post-Divorce, Principle of the Best Interests of the Child.
