Abstract

This study aims to analyze the position and evidentiary strength of the suppletoir oath as a means of proof in unlawful act cases. The background of this research is based on the importance of proof in civil procedural law and the relatively rare use of the suppletoir oath in judicial practice, despite its normative recognition in legislation. This research employs a normative juridical method with statutory, case, and conceptual approaches. The results indicate that the suppletoir oath serves as a complementary means of proof ordered by the judge when there is preliminary evidence, but it is insufficient to fully establish the judge’s conviction. Furthermore, the suppletoir oath has binding evidentiary force once it is taken, and it may serve as a basis for judicial consideration in deciding a case. In unlawful act cases, the use of the suppletoir oath becomes relevant particularly when other evidence is limited; however, its application must still observe the principle of prudence to avoid legal uncertainty. Thus, this study confirms that the suppletoir oath plays an important role as an alternative means of proof in civil procedural law, although its use remains limited in judicial practice.
