Abstract
The development of the digital era has encouraged the emergence of auction practices via social media, such as Instagram. However, in practice, this activity is not explicitly regulated in national auction regulations, specifically Minister of Finance Regulation Number 122 of 2023 concerning Auction Implementation Guidelines. This research aims to analyze the validity of auctions of goods conducted via Instagram and analyze the form of legal protection for buyers in these auction activities. The research method used is a normative juridical approach with a statutory approach and a conceptual approach, supported by the collection of legal materials through library studies. This research uses primary legal materials in the form of Minister of Finance Regulation Number 122 of 2023, the Civil Code, the Consumer Protection Law, and other related regulations. The research results show that auctions of goods on Instagram do not meet the requirements for auction validity as stipulated in the Minister of Finance Regulation Number 122 of 2023, so that these activities can only be qualified as ordinary buying and selling. As a result, buyers have no guarantee of legal certainty and increase the risk of loss for buyers. There are 2 (two) forms of legal protection for buyers, namely preventive legal protection, such as clarity and transparency of information regarding the condition of the goods. And repressive legal protection, such as allowing buyers to request returns or fees, claim for breach of contract, etc. Therefore, more comprehensive regulations are needed to provide legal certainty and legal protection for the public in auction practices on social media.
