Abstract
The Israeli-Palestinian conflict in Gaza has prompted the International Criminal Court (ICC) to issue an Arrest Warrant against Israeli Prime Minister Benjamin Netanyahu. This normative legal research aims to analyze the status and implications of the decision to issue the arrest warrant. The research results show that the issuance of this warrant is based on the territorial jurisdiction of the ICC through Palestine's membership in the 1998 Rome Statute, even though Israel is not a state party. The issuance of the arrest warrant against Benjamin Netanyahu has led to the rejection by several international legal subjects of the International Criminal Court's jurisdiction to exercise authority over states that are not party to the 1998 Rome Statute. The reluctance of international legal subjects to carry out their obligations to execute the ICC's arrest warrant can be penetrated by the principle, principles, and rules of international law that an individual who commits the most serious crimes at the international level cannot escape punishment. This decision creates a new dynamic in international law by placing the principle of individual accountability above traditional claims of sovereignty. The research findings reveal that this arrest warrant not only has legal consequences for Netanyahu, but also serves as a test of the effectiveness of the international criminal justice system in upholding justice amidst the complexities of global politics.
