Abstract

This study examines the juridical review of child rights fulfillment post-divorce from a civil law perspective, focusing on Case Number 76Pdt.G2023 PN Sda. The research addresses the regulation of child support after divorce, the authority of judges to establish child support for non-custodial parents, and the practical implications of the ruling. The study employs a normative juridical approach analyzing legislation, case law, and legal concepts. Findings indicate that the obligation to provide child support remains with both parents despite custody being granted to the mother; however, judicial decisions often lack explicit provisions on child support. This results in legal uncertainties and obstacles in fulfilling child rights. The study recommends enhancing judges' ex officio authority to mandate child support to ensure more effective protection of children's rights.
