Abstract

Children engage in narcotics offenses primarily due to lack of parental or community supervision, as well as emotional neglect from parents, which drives them to seek attention. Some children are influenced to experiment with narcotics after exposure to movies or social media trends that glamorize drug use. This study examines the handling of narcotics abuse cases involving children, focusing on Indonesia’s legal framework and the challenges in rehabilitation. Children are often targeted by drug dealers due to weak family oversight and negative environmental influences. Under Law No. 35 of 2009 on Narcotics and the Juvenile Criminal Justice System Law (UU SPPA), the legal approach emphasizes medical and social rehabilitation, as well as diversion measures to avoid criminal penalties for minors. Using a juridicalempirical method, this research combines legal analysis and case studies, supplemented by primary data from interviews with the National Narcotics Agency (BNN) of Surabaya. Findings reveal that rehabilitation for children is divided into inpatient and outpatient programs, with key obstacles including limited rehabilitation facilities, high costs, inadequate monitoring of outpatient cases, and inconsistent patient attendance in counseling sessions.
